ARTICLE 2- SUBJECT

The subject of this contract is to determine the rights and obligations of the parties in accordance with the provisions of the Law No. 4077 on the Protection of Consumers and the Regulation on Distance Contracts, regarding the sale and delivery of the product whose characteristics and sales price are specified below, which the BUYER has ordered electronically from the website owned by the SELLER.

ARTICLE 4- GENERAL PROVISIONS
 
4.1- BUYER declares that they have read and become informed about the basic qualities of the product subject to the contract, its sales price, payment method, and preliminary information regarding delivery on the website, and provided necessary confirmation in the electronic environment.
4.2- The subject product of the contract shall be delivered to the BUYER or the person/institution at the address specified by the BUYER within the period specified in the preliminary information on the website, depending on the distance of the BUYER's place of residence, not exceeding the legal 3-day period.
4.3- If the subject product of the contract is to be delivered to another person/institution other than the BUYER, the SELLER cannot be held responsible for the refusal of delivery by the recipient.
4.4- The SELLER is responsible for delivering the subject product of the contract in sound, complete, compliant with the specified qualifications in the order, along with any warranty documents and user manuals if available.
4.5- For the delivery of the subject product, it is a condition that the signed copy of this contract has been delivered to the SELLER and the payment has been made by the BUYER in the payment method they prefer. In case the product price is not paid for any reason or is cancelled in the bank records, the SELLER is considered relieved from the obligation to deliver the product.
4.6- If, after the delivery of the product, the BUYER's credit card is used unlawfully or in violation of the law by unauthorized persons for reasons not arising from the BUYER's fault, the BUYER is obliged to return the product to the SELLER within 3 days upon being informed, provided that the product has been delivered to the BUYER. In this case, the shipping costs belong to the BUYER.
4.7- If, due to force majeure or extraordinary situations such as obstructive weather conditions or cessation of transportation, the SELLER cannot deliver the subject product of the contract within the specified period, they are obliged to notify the BUYER. In this case, the BUYER may cancel the order, request a replacement with a similar product, and/or postpone the delivery period until the obstructive situation is resolved. If the BUYER cancels the order, the amount paid is refunded within 10 days.
4.8- For products sold with a warranty certificate or without, defective or malfunctioning products can be sent to the SELLER for necessary repairs within the warranty conditions, and in this case, the shipping costs will be covered by the SELLER.

ARTICLE 5- RIGHT OF WITHDRAWAL

The BUYER has the right of withdrawal within 7 days from the delivery of the product to themselves or the person/institution at the specified address. To exercise the right of withdrawal, it is necessary to notify the SELLER via fax, email, or phone within this period, and the product must not have been used within the framework of article 6. In case of exercising this right, it is mandatory to return the original invoice and a copy of the cargo delivery note showing that the product delivered to a third party or the BUYER has been sent to the SELLER. The product price is refunded within 7 days after the receipt of these documents. If the original invoice is not sent, VAT and any other legal obligations cannot be refunded. The shipping cost for the product returned due to the right of withdrawal is covered by the SELLER.

ARTICLE 6- PRODUCTS THAT CANNOT BE WITHDRAWN

Products that cannot be returned due to their nature, single-use products, copyable software and programs, perishable or expired products cannot be withdrawn. The right of withdrawal for the following products is subject to the condition that the product's packaging is unopened, undamaged, and the product is unused.

-Portable Computers (No returns after the original operating system is installed.)
-All kinds of software and programs
-DVDs, VCDs, CDs, and cassettes
-Computer and stationery consumables (toner, cartridge, ribbon, etc.)
-All types of cosmetic products
-Phone credit orders

ARTICLE 7- COMPETENT COURT

In the implementation of this contract, Consumer Arbitration Committees declared by the Ministry of Industry and Commerce up to the declared value and Consumer Courts in the place of residence of the BUYER or SELLER are authorized.

By completing the order, the BUYER is considered to have accepted all the conditions of this contract.
